Why aren't all of your cases settling in mediation? Why do you sometimes find that mediations are conducted in a manner that is not what you expect?

The ABA Task Force on Mediation Quality conducted meetings with mediation users (mainly lawyers, some parties) in ten cities across North America and collected important insights into what users like and don't like--what those users believe works and what doesn't. The 2008 Task Force Report made findings about several areas of mediation practice that were themes for repeated critique and analysis in our meetings: mediation preparation by parties, counsel, and mediators; case-by-case customization of the mediation process; use of analytical techniques by mediators; and persistence and follow-up by mediators.

Four members of the Task Force--an in-house lawyer for a major insurance company, a litigator in a large law firm, and two mediators-will discuss the findings of the Task Force.

The discussion will focus on how mediators engage parties and counsel with different analytical techniques, targeting both the merits of disputes and negotiating issues-and how they do so consistent with the goal of providing the highest quality mediation services.
