Expedited Arbitration Claims of $74,999 & Under

Contracts with arbitration provisions require that parties file with an arbitration forum rather than filing the dispute in court.  Arbitration claims with lower dollar amounts can be costly to to file when using a larger, national forum.  The expenses associated with arbitration are paid for entirely by the parties, as opposed to court costs which are funded by taxes and a small filing fee by the claimant and respondent.  A cost / benefit analysis of the arbitration fees versis the amount in dispute may be a strong deterrant to resolution. 

Colorado Mediators & Arbitrators LLC has designed a program to address concerns of the parties when a lower dollar dispute must be filed.  We offer the following in an effort to contain costs for all parties and provide a greater value to our Colorado communities.

  1. Arbitration offers a less formal hearing.  Many parties feel they can manage the arbitration process without the representation of an attorney, which significantly reduces costs.  A legal process is more complicated, and what is saved in administrative fees may be paid out for legal representation.
  2. Arbitration saves total time from starting the case to completion.  This is especially true in our current economy, as governments struggle to meet expenses through court staff reductions.
  3. CoMA's Expedited Arbitration process saves money.  The flat fee for 4 hours of hearing encourages parties to present the most important points of their case while keeping an eye on total cost for resolution.  The parties drive the process however; when additional time is needed, it is available in 15 minute incremental charges.
